The essence of the claims against the once best builder of the Don region, who suddenly became the worst, has not changed over the years that he rested in the popular resorts of Thailand and other resort countries of the world. The "Caucasian Knot" has reported that on March 27, the owner of the construction company "Vant" was extradited from the Thai resort of Pattaya to Moscow in connection with a criminal case on embezzlement of funds from equity holders of unfinished apartment buildings in Rostov-on-Don in the amount of more than 322 million rubles. Then Chabanov was taken from Moscow to Rostov-on-Don, where a measure of restraint was chosen for him in the form of detention. His wife Nadezhda Chabanova, who is also accused in a criminal case and has recently been in the United Arab Emirates, will not be extradited to Russia due to reaching the age of 60.

It was established that the suspect ran a company that attracted funds from citizens to participate in shared construction in the absence of the necessary permits for the construction of houses, the law enforcement agencies of the Rostov region said.

It will soon be exactly one year since the director of the once largest construction concern VANT, Valery Chabanov, is in the Rostov pre-trial detention center No. 1. He is accused of deliberately stealing the funds of equity holders. The donnews.ru journalist met with Valery Chabanov's daughter, Tatyana, and found out why everything in this process is far from being as simple as it seems at first glance.

From scratch to the largest developer in the south of Russia

The VANT Concern has been leading its history since the early 2000s. In total, it included about 30 different companies, whose offices were located in a 10-storey building on the street. 50th anniversary of Rostselmash. “My father always dreamed of organizing a closed cycle of construction, so that everything needed for the construction of residential buildings would be produced inside the concern,” explains Tatyana.

Since the start of its activities, the concern has put into operation about 650 thousand square meters of housing in Rostov-on-Don, Bataysk, Azov, Tuapse, Sochi, Novorossiysk. At that time, VANT was the largest developer in the Southern Federal District.

- For understanding - a standard 10-storey residential building, it's about 5 thousand square meters. That is, we are talking about hundreds of houses handed over. This alone already suggests that VANT is not a company of some kind of scammers, as many people now believe, after publications in the media, - says Tatyana.

Beginning of the End

Everything was fine until 2008, when the economic crisis struck. A massive outflow of capital began, the mortgage market actually collapsed, developers went bankrupt en masse. Property prices have plummeted.

- There were no new investors, equity holders, and the old ones began to terminate contracts, massively demanding their money back. After all, they bought housing for 45-50 thousand rubles per square meter, and prices fell to 30 thousand, in fact, to the cost of construction. Builders, including my father, “thrown out” what they could on the market in order to get at least some funds for the completion of the houses they had begun, but this was not bought either. Meanwhile, people, often in groups of 30-40 people, collected tens of millions of rubles from the companies of the concern for their money. As best they could, they defended their rights. Nobody blames them,” says the daughter of the general director of the VANT concern.

Since similar stories took place throughout the country, the so-called problem of "deceived equity holders" reached the federal level. The regional authorities were ordered to resolve the situation, that is, to complete the construction of houses. Regular meetings began in the Rostov region with the participation of all the top officials of the region, including representatives of law enforcement agencies. At each of them, not hiding from anyone, Valery Chabanov was regularly present.

Finding a Solution

In 2010, the director of the VANT concern made a decision - on the security of his own real estate, with a total value of about 3 billion rubles (a restaurant complex and a land plot in the center of Sochi on Kurortny Prospekt and the same 10-story office building of the concern for the 50th anniversary of Rostselmash in Rostov), ​​Chabanov agreed with YuZB Sberbank to provide a credit line of 1.3 billion rubles for the completion of all problematic facilities. At that moment, he could no longer attract an ordinary bank loan, since equity holders, believing that they had been deceived, began to file claims for bankruptcy of the concern.

However, soon the leadership of the SWB Sberbank changed and the first requirement of the new team was the provision of a bank guarantee by the authorities of the Rostov region to the concern.

“But at that time the region could not afford it even technically, since the budget had already been allotted. As a result, lending to the concern by Sberbank stopped after the very first tranches totaling 270 million rubles, which were used to complete the construction of about 3-4 apartment buildings. At the same time, the bank did not release the property that the father pledged under this credit line. The pledged property of VANT for a total amount of more than 3 billion rubles is being collected by Sberbank to this day, although only 270 million were issued on credit, instead of 1.3 billion, Tatyana says.

She is sure that if this money were completely transferred to VANT, then there would be no “deceived equity holders” now.

- There is such a company in Krasnodar - Development Yug, which had even more serious problems in those years. They needed 3 billion rubles to fulfill their obligations, and they were able to find them in banks. Now it is a successful company that has recently entered the market of the Rostov region. "VANT" needed only 1.3 billion, but Sberbank did not fulfill its obligations to the end, - says Tatyana.

At the same time, Valery Chabanov lost his last major assets - the Expanded Clay and Concrete Parts Plant in Krasny Sulin, a brick factory in the Myasnikovsky district, and so on. These enterprises were given to VANT's creditors as "compensation" so that they would not bankrupt the enterprises and the concern could continue to look for opportunities to fulfill its obligations to equity holders.

At the same time, Tatyana continues, the authorities of the Rostov region have developed a scheme according to which VANT, through the Regional Mortgage Corporation, would transfer all the unsold square meters of housing to an attracted Moscow investor - CJSC METALLURGSPETSOBORUDOVANIE.

- The transfer was offered actually at the cost of construction. On average, 30 thousand rubles per square meter. According to the representatives of the investor, for the difference between how much they bought it for and how much it really costs, they will finish building houses. According to the regional program developed at that time, in return they were to receive free land plots from the authorities for their own construction. Shortly before his departure, the father, together with all the directors, decided to agree to these conditions, she says.

Departure from Russia

According to Tatyana, contrary to popular belief, her father did not flee the country to escape criminal prosecution.

- At the end of 2011-beginning of 2012, he left for treatment. Previously, he was diagnosed with cancer. In the course of all events, he simply “launched” himself. The disease progressed and required treatment. At this time, my father left the country several times, including in Rostov hospitals. Criminal cases on the statements of VANT equity holders had been underway for several years by this time, Valery Chabanov appeared in them as a witness.

However, while he was once again abroad for treatment, at the initiative of the prosecutor Kuznetsov, an arrest warrant was signed in his name. To come for him meant to be detained while crossing the border of the Russian Federation and transferred to a pre-trial detention center. Further developments are widely known. In October 2012, Valery Chabanov was put on the federal wanted list, a year later - on the international wanted list through Interpol. He is charged with article 159 part 4 of the Criminal Code of the Russian Federation - fraud on an especially large scale as part of a group of persons.

As a result, in February 2016 he was detained in Thailand and soon deported to Russia. In mid-August, the criminal case against Valery Chabanov was brought to court.

Trial

Currently, the case against Valery Chabanov is being considered by the Kirovsky District Court of Rostov. Five houses appear in the process, some of which raise serious questions from the defense side.

- The crisis of 2008 led to the fact that VANT did not complete the construction of about 16 houses. About 10 of them were never completed, six were commissioned. At the same time, objects on which the conflict has long been resolved appear in the case. For example, ZhSK "Botanical Garden". Back in 2008, when it became clear that this facility would not be built, people were given either monetary compensation or apartments in another building on Gorky Street. The same situation with the house on Shtakhanovskogo\Dneprovskogo. Shareholders were provided with housing in 4 other five-story buildings, 3 have already been put into operation. The house on Universitetsky-Filimonovskaya-Lermontovskaya Street was put into operation last year. - says Tatyana.

According to her, the prosecution explains this situation by the fact that Valery Chabanov, allegedly being a fraudster, at some point decided to hide his “criminal deeds”, compensating for the harm caused.

- The article presented to my father clearly formulates - the original intent to cheat, without the intention to fulfill their obligations to people. The facts say otherwise. My father, even when he was in a crisis situation, took all possible steps to complete the construction of the houses,” says the daughter of the director of the VANT concern.

The defense has other questions regarding the “grave” article of the Criminal Code of the Russian Federation presented to Chabanov. The fact is that initially there were several suspects in the VANT case. Later, since Valery Chabanov was not in Russia, the case against him was separated into a separate proceeding. Other suspects have long been convicted, but under a completely different, “entrepreneurial” article on contract fraud, which qualifies as moderate. It does not imply detention in a pre-trial detention center during the investigation and court proceedings, the maximum punishment for it is two times less - five, not ten years in prison.

- It turns out that my father and the people who, as the court decided, aided him, were held under different articles. But they are accused of one crime. In the VANT case, three trials were completed, which gave an assessment of this whole story. This is called the principle of prejudice. But for some reason it doesn't work for my father. But 10 years in a general regime colony for a 63-year-old cancer patient is a death sentence, says Tatyana.

Unjustified cruelty

According to the daughter of the director of the VANT concern, there are several reasons why the process in the case of Valery Chabanov is developing in this way.

On the one hand, there is a request from the public, which "thirsts for blood." Since the joint efforts of officials, who for 8 years have not been able to solve the problem of unfinished VANT, and the media have led to the fact that the name of the concern and the name of its director are now unequivocally associated with the words "swindlers and thieves." After all, people who happily live in the houses built and handed over by VANT will not go to a rally in his defense. No one remembers past merits, and it is always convenient when there is one main culprit.

On the other hand, Tatyana claims, other interested persons are also involved in the case, for whom it is extremely unprofitable for Valery Vladimirovich to be at large.

- Of all the large assets of the father until the moment of arrest, only one remained - this is half of the land plot on Beregovaya Street in Rostov. The total cost of the land is about 400 million rubles. The site was burdened for a long time. The owner of one half - a former partner of his father - sold his share. The second part of the site, owned by Valery Chabanov, changed its owner through a virtual raider seizure. Now one widely advertised residential complex is being built on this land. While at large, the father would have every right to make claims to this land or to compensation for its value. I have no doubt that this money would be used to complete the construction of "problem" facilities, - explains Tatyana.

Currently, Valery Chabanov is hospitalized in MOTB-19 in Rostov, that is, he is in a prison hospital. After taking the strongest painkillers for more than 4 hours in today's frosts, he is taken to the courtroom for the next session 3 times a week, and then the same way back to the pre-trial detention center. The body of the sick entrepreneur simply could not cope. The trial of Valery Chabanov is at the stage of questioning witnesses for the prosecution.

- I attend meetings. Not a single so-called "witness for the prosecution" has yet said anything against the father. On the contrary, company employees, designers, contractors, if they can say something about my father, then only good things. Therefore, they are more likely witnesses for the defense than for the prosecution. After all, the prosecution has to prove that my father, not actually being the director of the enterprise, having no access to the accounts of companies, to the funds of equity holders (none of them had ever even seen him), somehow stole this money. But how to prove something that didn’t exist?! — says the entrepreneur’s daughter

The process itself is frankly accusatory. All petitions of the prosecution are satisfied by the court, the defense is rejected. The reclassification of the article to a softer one, the one by which other participants in the VANT case were judged, is not even considered. After all, then the whole story with the search through Interpol and the detention of my father would become illegal. The state does not spend money on searching for suspects of minor crimes, Tatyana says.

On Monday, February 13, the prosecution will demand to extend the term of Valery Chabanov's detention in the pre-trial detention center for another six months. His relatives and defenders insist on house arrest, but the Rostov courts over and over again refuse to change the measure of restraint.

- His condition now is such that being in the courtroom, he often simply does not understand what is happening. It affects the effect of the drugs he needs. My father is not going to run away from the court, but he needs treatment, normal care and human conditions of detention, Tatyana insists.

We add that in early February of this year it became known that Boris Titov, Commissioner for the Rights of Entrepreneurs under the President of the Russian Federation, turned to the Chairman of the Supreme Court with a request to check the validity of the detention of entrepreneurs convicted under economic articles. Nearly a third of the list are businessmen from the Rostov region. Among them is Valery Chabanov.

In Russia, two of our compatriots Evgeny Gubarev and Vladimir Toropchinov, suspected of serious crimes, landed at the Moscow airport, as a message came from the kingdom: there, in the Thai resort of Pattaya, Valery Chabanov, chairman of the board of directors of the Vant construction concern, was detained. He was wanted by Interpol for major fraud in his homeland. This was announced by the head of the consular department of the Russian Embassy in Thailand, Vladimir Sosnov.

According to some reports, 62-year-old Valery Chabanov was detained two weeks ago on a tip from Russian diplomats. It is known that when the police asked the fugitive to show documents, Chabanov showed a passport in the name of Lajos Icuarto. But the immigration officials did not believe him. They took the man to the police station, where Russian embassy officials identified him.

Recall that in October 2012, Chabanov was put on the federal wanted list, a year later - on the international wanted list through Interpol, along with his wife. As it turned out, they had not lived in Russia since 2010. The couple are suspected of fraud - embezzlement and embezzlement on an especially large scale. As for the wife of the owner of the construction concern "Vant", Nadezhda Chabanova was detained at the beginning of July last year in the United Arab Emirates.

According to investigators, "Vant" was supposed to build four multi-apartment residential buildings in Rostov, but did not. The funds received were not invested in the construction, and no one paid the designers. As a result, 256 equity holders were deceived, the total amount of damage exceeded 322 million rubles. In the summer of 2010, deceived equity holders began to go to rallies, trying to draw the attention of local authorities to this problem. Chabanov himself ignored these meetings.

Back in 2013, the Vedomosti newspaper spoke in detail about Chabanov's adventures. According to the investigation, the construction concern "Vant" was created from several construction companies that had either common owners or common interests in the housing construction market. Housing was built mainly in Rostov, several projects were carried out in Sochi. At first, Vanta did well: in 2008, the concern put into operation about 90,000 sq.m. housing. The houses were built with funds from equity holders and bank loans. However, after the financial crisis, "Ventu" was no longer given on credit, and he could no longer complete the construction of houses at the expense of equity holders. The money was spent on other projects. The construction of 18 houses was frozen, and the number of deceived equity holders amounted to over 2,000 people. In the fall of 2009, the concern's debts to banks rose to 400 million rubles. Chabanov went abroad in 2010 and for a long time tried to sell his private house in the Rostov region for 150 million rubles.

Partially, the problem of equity holders was solved. According to the former deputy general director of IC "Vant" Yegor Parakhin, in 2010-2012, by attracting loans and investors, the concern was able to complete six houses out of 18. But as soon as the situation around Chabanov personally began to deteriorate, he left the country and the resolution of issues ceased, although opportunities were. Some large developers of "Vanta" - LLC "Maria" LLC "Donkvartstroy" - went bankrupt. On the activities of "Maria" a fraud case was also initiated (in fact, not against a specific leadership). But the Ministry of Internal Affairs did not report its results.

After numerous rallies, the regional authorities began to deal with the problem of equity holders. Rostov Regional Mortgage Corporation (RRIC), owned by the regional government, began to control the sale of apartments in the remaining Vanta properties. In each house erected "under the roof", "Vant" has unsold apartments, the money received for them can be used to complete the construction of houses and resolve the issue of resettlement of equity holders. Although no one gives loans to the “daughters” of “Vanta” who are completing the construction of houses, they somehow get out and complete the construction with the money they earn.

When Valery Chabanov will be deported back to Russia is still unknown.

An acquaintance of Chabanov knows that he left the Russian Federation back in 2010 and for a long time tried to sell his private house in the Rostov region for 150 million rubles.

The Vanta crisis was caused by a combination of circumstances, says Yegor Parakhin, former deputy general director of Vanta Insurance Company. Now he also works for a contractor that builds residential buildings (he does not say which one), but is not connected with Vant. He also has not seen Chabanov for a long time and does not know where he is, he considers the initiation of a case a “purely formal approach” to resolving the issue of equity holders. According to Parakhin, the problem of equity holders was partially solved: “In 2010-2012, we by attracting loans and investors, they were able to complete the construction of six houses out of 18, but as soon as the situation around Chabanov personally began to deteriorate, he left the country and the resolution of issues ceased, although there were opportunities. Some large property developers Vanta (Maria LLC and Donkvartstroy LLC) went bankrupt. A fraud case was also initiated regarding the activities of “Maria” (in fact, not against a specific leadership), but the Main Directorate of the Ministry of Internal Affairs did not report its results.

After numerous rallies, the regional authorities began to deal with the problem of equity holders. Two years ago, Rostov Regional Mortgage Corporation (RRIC), owned by the regional government, began to control the sale of apartments in the remaining Vanta properties. “The corporation is an agent for the sale of unsold apartments, controls the financial costs of completing the houses,” said Alexander Andryushchenko, General Director of the RRIC. According to him, Vanta still has unsold apartments in each house, the money raised for them can be used to complete the construction of houses and resolve the issue of resettlement of equity holders (now there are about 1,000 people left). The “daughters” of “Vanta” are completing the construction of houses, no one gives them loans, they are completing the construction on the earned money,” he says.

Disinformation appeared on Internet news sites the day before that Andrei Chabanov, a former deputy of the Rostov-on-Don City Duma, put on the international wanted list, allegedly belongs to the United Russia party. In fact, Andrei Chabanov was nominated to the City Duma of Rostov-on-Don of the fourth convocation (2005-2010) from the LDPR and was never a member of the United Russia party.
